Raymond D. Battocchi, Partner, has 38 years of litigation experience, including complex and multi-district litigation throughout the United States.
Fresh out of law school, Battocchi found himself representing the U.S. government in complex and high-profile cases, including defending Robert Bork’s firing of Archibald Cox during the Watergate affair in a civil suit brought by Ralph Nader and others.
Since his 8-year stint with the Department of Justice, Battocchi has spent 28 years in private practice handling a wide variety of civil cases. He has tried cases in a many jurisdictions, though he now practices mostly in Northern Virginia and the District of Columbia. He has briefed and argued over 70 appeals, and presented oral arguments in the U.S. Supreme Court, all 13 Federal Circuit Courts, the Virginia Supreme Court, the Virginia Court of Appeals, and the D.C. Court of Appeals.
“When I get up in the morning, I look forward to going to work on my cases,” says Battocchi. He looks upon each case as a new challenge. He litigates cases vigorously, and tries to get the best result he can for his clients. But he also prides himself on working to maintain professional and cordial relations with opposing counsel and others involved in cases.

Representative Large Case Experience
1994 to 2002. Wyatt v. United States, 271 F.3d 1090 (Fed. Cir. 2001), cert. denied, 122 S.Ct. 1960 (2002). Eight year contingent fee litigation involving real property takings claims against the United States. $33 million judgment obtained after trial was reversed on appeal.
1981 to 1991. Reuber v. Food Chemical News, Inc., 925 F.2d 703 (4 th Cir. 1991) (en banc), cert. denied, 501 U.S. 1212 (1991). Defamation and civil rights claims by individual against newspaper and several governmental officials. Case involved two thirteen day trials and several appeals.
1980 to 1983. Curtiss Wright Corp. v. General Electric Co., 446 U.S. 1 (1980). Represented General Electric along with other partners in several year case involving millions of pages of documents, supervision of up to 30 paralegals, and 70 or more depositions, some lasting up to two weeks. Initial experience with automating discovery materials.
1977 to 1981. Air Crash Disaster Near Saigon, South Vietnam. Partner primarily responsible for litigating multi-district case on behalf of several dozen plaintiffs. Numerous depositions, voluminous document production, and argument of various pre-trial motions.
1973 to 1977. Meiners v. Bloemker. Justice Department lawyer primarily responsible for litigating through trial and appeal several civil cases against drug enforcement agents who conducted mistaken raids.
Representative Small Case Experience
Corporate Control. Suit by siblings seeking to take away part owner’s stock and control of family corporation. Dual & Associates, Inc. v. Wells, 241 Va. 542, 403 S.E.2d 354 (1991).
Securities and Divorce. Suit by wife under securities and domestic relations law seeking many millions from ex-husband. Luken v. Luken (unreported).
Free Speech, International Law. Suit seeking to have statute prohibiting public demonstrations held unconstitutional. Boos v. Barry, 485 U.S. 312 (1988).
Breach of Contract. Damages sought under contract and lease. Cane Tennessee, Inc. v. Eastern Minerals International, Inc. (arbitration).
Negotiable Instruments. Suit by corporate officer under negotiable instruments. Ghariani v. Kim, 790 F.2d 888 (4 th Cir. 1986).
Domestic Relations. Equitable distribution proceeding to divide assets. Peterson v. Peterson (unreported).
Products Liability. Claims for breach of warranty and contract. Bennett Air Conditioning v. Warren Manufacturing Co., 23 F.3d 399 (4 th Cir. 1994) (unpublished).
Employment Dispute. Suit by employee for wages and commissions. Hunter v. Phone Base, Inc. (unreported).
Insurance. Suit against insurer under directors and officers insurance policy. Partnership Umbrella, Inc. v. Federal Insurance Co., 260 Va. 123, 530 S.E.2d 154 (2000).
Tax. Suit against IRS challenging tax collection. Triad, Inc. v. United States (unreported).
Government contracts. Suit by governmental contractor before ASBCA. Dual Incorporated v. United States (unreported and pending).
Bankruptcy. Litigation of creditor’s claims in bankruptcy. In re Caucus Distributors, Inc. (unreported).
Partnerships. Suit by law partners after law firm dissolved. Sterlacci v. Jenkins.
Personal Injury. Slip and fall suit against homeowners association. Lewis v. Courthouse Station Homeowners Ass’n., Inc. (unreported).
Torts. Claims by and counterclaims against former corporate employees for tortious interference and conspiracy. Socrates, Inc. v. Khosrovian (unreported).
